Fetus a Person, Says South Carolina Court
A fetus is a person and is covered by child abuse laws, South
Carolina's highest court ruled. In a 3-2 decision upholding an 8-year prison sentence dealt to a woman charged with child neglect after tests showed her newborn baby had been exposed to cocaine in utero, the majority reached a different
conclusion than every other state high court that has dealt with the question.

Lynn Paltrow, a reproductive-rights lawyer who represented the baby's mother, Cornelia Whitner, said she plans to appeal. Paltrow noted that defining a fetus as a person means that women who undergo legal abortion procedures could be charged with murder.  (The New York Times)
